Booking Terms and Conditions

§1 Scope & Contractual Partner

These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts for the rental of apartments for accommodation purposes concluded between M-OASE, owner Malgorzata Wittneben, and third parties (guests). The contractual partner of the guest in Germany is M-OASE, owner Malgorzata Wittneben. The customer’s own general terms and conditions shall only apply if expressly agreed upon in written form beforehand.

§2 Reservation and Booking

By completing a reservation/booking, the guest offers to enter into an accommodation contract. If the requested apartment is available, M-OASE (owner Malgorzata Wittneben) will confirm the reservation/booking, thereby establishing a binding accommodation contract. M-OASE reserves the right to decline the conclusion of an accommodation contract at its sole discretion. The person making the booking does so on behalf of all persons listed in the booking and is liable for their obligations, including ensuring the number of occupants does not exceed what is permitted. This includes children, infants, and teenagers. There is no right to occupy the property with more people than agreed upon. The landlord may refuse additional guests or require extra payment.

§3 Cancellation Policy

A guaranteed reservation is only confirmed upon receipt of payment by M-OASE (owner Malgorzata Wittneben). The guest may cancel the booking free of charge in accordance with the stated cancellation policy and deadlines. All cancellations must be made in writing and must include the booking number. If no right of withdrawal was agreed or the free cancellation period has already expired, and M-OASE does not consent to contract termination, the full agreed price remains payable — even if the service is not used (no-show) or cancellation is made too late.

Cancellation policy:
Cancellations up to 15 days before arrival: Full refund
Cancellations between 14 and 8 days before arrival: 50% refund
Cancellations within 7 days of arrival: No refund
Exception: Cancellations made within 24 hours of booking are free of charge. This policy only applies to bookings made at least 24 hours prior to arrival.

For bookings made via platforms like Airbnb or Booking.com, the respective platform’s cancellation policy applies.

Pandemic-related cancellations: Up to 5 days before arrival: 100% refund of the rental price and cleaning fee, minus the cost of the first night. From 5 days before arrival: 50% refund of the rental price, 100% refund of the cleaning fee.

Early departure or late arrival does not entitle the guest to a price reduction.

§4 Arrival and Departure

The apartment is available from 4:00 PM on the day of arrival and must be vacated by 11:00 AM on the day of departure. Early check-in or late check-out may be arranged on request and subject to availability. A surcharge of €10.00 per additional hour will apply.

§5 Duty of Care

The guest must treat the rented property and its furnishings with care. Damages must be reported and compensated by the guest. Upon arrival, the guest should check the inventory for completeness and functionality and report any issues immediately. Any damage occurring during the stay must also be reported immediately. Failure to report damages voids the right to a rent reduction. The landlord is entitled to claim compensation for unreported damage discovered after check-out. Rearranging furniture or using unused beds and bed linens is prohibited. The landlord may charge an additional cleaning fee for violations. TV settings must not be altered. Netflix access may only be used in the apartment. Unauthorized use will result in a charge.

§6 Prices and Additional Fees

The prices stated at the time of booking by M-OASE are final, including all statutory taxes, charges, and fees. Local fees (e.g., tourist tax) that the guest is personally liable for are not included.

§7 Payment Terms and Invoicing

All accommodation fees must be paid in advance by the guest. Offsetting by the guest is excluded unless the claim is undisputed or legally binding. Accepted payment methods include: MasterCard, Visa, American Express, Sofortüberweisung/Klarna, PayPal, and bank transfer. Cash is not accepted. M-OASE reserves the right to charge the stored payment method for any additional services or violations of these terms. The guest expressly authorizes this. By booking, the guest agrees to receive invoices via download or email.

§8 Non-Smoking Policy

All M-OASE apartments are non-smoking units. Smoking is strictly prohibited in the apartments and communal areas. This includes e-cigarettes, shishas, tobacco heaters, and similar devices. Violations incur a fee of €250 plus special cleaning costs.

§9 Pets

Pets are not allowed. Violations incur an extra cleaning fee of €150. Exceptions are made for certified service dogs (e.g., guide or hearing dogs) with appropriate documentation, which must be submitted prior to check-in.

§10 Access to the Apartment Access is provided via a key box or smart lock. The guest receives a code on the day of arrival to retrieve the key or access the smart lock. In case of key loss, the guest is responsible for replacing the lock and three keys.

§11 Liability

The landlord is only liable for damages caused intentionally or by gross negligence. In the case of minor negligence, liability is limited to typical and foreseeable damages. This exclusion does not apply in cases of injury to life, body, or health. The provider is not liable for items brought into the property; they do not constitute “brought-in property” under §§701 ff. BGB (German Civil Code). This also applies explicitly to valuables stored or left in the apartment. The landlord is not liable for disturbances caused by force majeure (war, civil unrest, storms, pandemics, fire, construction noise, bad weather, cold, terrorist acts, etc.). In such cases, additional costs or rental losses are borne by the guest.

§12 Final Provisions & Severability Clause

Any amendments or additions to the accommodation contract or these GTC must be in written form. Unilateral changes by the guest are invalid. These GTC are deemed accepted upon request and/or acceptance of the accommodation contract. Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that most closely reflects the economic and legal intent of the parties.
